In a letter addressed to the American billionaire, Breton emphasized the requirements under the new European legislation for digital services (DSA), highlighting that the moderation imperative applies to all X users, including Musk himself.

Elon Musk, with over 193 million subscribers after acquiring the social network in 2022, is known for incendiary messages against American Democrats. He was set to conduct a live interview on X with the Republican presidential candidate, whom he strongly supports. Breton reminded Musk in his letter that this exchange would also be accessible to EU X users, affirming vigilance on potential DSA violations and the commitment to use all necessary measures to protect European citizens.

Compliance Challenges for Social Media Platforms

The DSA mandates online platforms to implement a content flagging system and take swift action to remove illicit content or restrict access upon awareness. Following Musk’s acquisition of Twitter and subsequent mass layoffs affecting moderation teams, Brussels initiated a formal investigation against X for suspected compliance failures in combating disinformation. The European Commission raised concerns about insufficient moderators and an ineffective illicit content reporting system, prompting X to reiterate its commitment to regulatory compliance.

Tensions Between Elon Musk and European Authorities

Thierry Breton had visited San Francisco in spring 2023 to discuss European regulations with Musk, leading to public displays of unity that later evolved into strained exchanges, primarily through social media. Musk accused Brussels of attempting a “secret deal” to censor content, which Breton vehemently denied, asserting transparency and Musk’s freedom to propose commitments. The once amicable relationship between Breton and Musk deteriorated over time, culminating in public disagreements and potential legal actions.
