Bottled Mineral Water: Nestlé Waters to Face a 2 Million Euros Fine, Organizations Criticize an “Ineffective Justice System”

Nestlé Waters Concludes Public Interest Agreement and Pays Fine

Nestlé Waters will pay a fine of 2 million euros after entering into a public interest judicial agreement with the public prosecutor of Epinal following two preliminary investigations announced by the prosecutor on Tuesday, September 10th. The investigations revolved around potential illegal drilling in the groundwater and prohibited treatments that Nestlé admitted to implementing for its mineral waters.

Environmental Impact and Reparation

As part of the agreement, Nestlé Waters has committed to paying the fine within three months. The company has also pledged to address the ecological impact through the implementation of a comprehensive plan for ecological renaturation and restoration. Additionally, Nestlé will compensate several environmental defense organizations totaling 516,800 euros.

Significance of the Public Interest Agreement

This CJIP is deemed as the most significant environmental agreement signed in France to date, according to the Epinal public prosecutor. The conclusion of this agreement stemmed from the two preliminary investigations, one concerning administrative authorizations for the operation of nine out of the one hundred thirty water catchments used for marketing Nestlé Waters’ mineral waters.

Criticism and Responses

While Nestlé Waters halted the irregularities and unauthorized water treatments, criticisms arose regarding the CJIP, with some perceiving it as a way to bypass a proper trial for those with financial means. Despite the criticisms, parties involved opted for the CJIP to expedite regulatory compliance, ecological impact reparation, and compensation.

Conclusion

The agreement with Nestlé Waters comes amidst a growing awareness of environmental accountability and the challenges of balancing legal justice with rapid environmental action. Ultimately, the public interest agreement aims to address the identified issues promptly and pave the way for restoring ecological balance.
